1. About us
FortMind is a cybersecurity training, advisory, and talent firm based in Doha, State of Qatar. References to “FortMind”, “we”, “us”, or “our” mean FortMind and its affiliates. References to “you” or “your” mean the individual or legal entity using the website or our services. If you accept these Terms on behalf of an organization, you represent that you have authority to bind that organization.
2. Eligibility
You must be at least 18 years old (or the legal age of majority in your jurisdiction) and capable of forming a legally binding contract to use the website or our services. We may, at our discretion, decline to provide services to any person or entity, including persons or entities subject to applicable trade sanctions.
3. Engagements and services
Cybersecurity assessments, training programs, talent placement, and consulting engagements are governed by a separate written agreement between FortMind and the client (a Statement of Work, Master Services Agreement, course enrollment terms, or similar). In the event of any conflict, that signed engagement agreement prevails over these Terms with respect to the engagement.
Quotes, proposals, indicative pricing, and information published on the website are provided for general information and do not constitute a binding offer.
4. Course enrollment, fees, and refunds
Enrollment in a course is confirmed only after FortMind accepts the registration and payment of the applicable fees. Fees, payment schedules, applicable taxes, and any refund or cancellation policy are stated at the point of enrollment or in the relevant order form.
Unless stated otherwise in writing, fees are non-refundable once the course has commenced. Where a refund is permitted, it will be processed via the original payment method within a reasonable period, net of any administrative or third-party processing charges.
FortMind may reschedule, modify, or cancel a course where reasonably necessary (for example, due to insufficient enrollment, instructor unavailability, or events of force majeure) and will offer a comparable alternative or a refund of unused fees.
5. Accounts and credentials
If the website provides accounts (for example, learner portals, client dashboards, or document workspaces), you are responsible for keeping your credentials confidential, for all activity carried out under your account, and for promptly notifying us of any suspected unauthorized access. We may suspend or disable access where necessary to protect the security of the platform or other users.
6. Acceptable use
You agree not to use the website or our services to: (a) violate any applicable law, regulation, or third-party right; (b) attempt to disrupt, reverse-engineer, probe, or test the vulnerability of the website or any FortMind system without prior written authorization; (c) scrape, harvest, or systematically extract content; (d) misuse forms, APIs, or messaging features; (e) develop, distribute, or use offensive cyber capabilities against any third party without lawful authorization; (f) impersonate any person or entity or misrepresent affiliation; or (g) introduce malware, ransomware, or any other harmful code.
We may investigate suspected breaches and may suspend or terminate access, remove content, and report unlawful activity to the competent authorities.
7. Intellectual property
All content on the website and in our training and consulting materials — including text, graphics, logos, images, photographs, videos, course outlines, lab environments, methodologies, frameworks, source code, reports, and the selection and arrangement thereof — is owned by FortMind or its licensors and is protected by copyright, trademark, and other intellectual-property laws.
Subject to your compliance with these Terms, FortMind grants you a limited, non-exclusive, non-transferable, revocable license to access and view the website and to use the materials we deliver to you only for your internal business or personal learning purposes. You may not copy, reproduce, redistribute, publicly display, host, sublicense, sell, or create derivative works from our materials without our prior written consent.
Trade names, trademarks, service marks, and logos displayed on the website are the property of FortMind or their respective owners. Nothing in these Terms grants you any right to use them.
8. Feedback
If you submit ideas, suggestions, or feedback about the website, our courses, or our services, you grant FortMind a worldwide, perpetual, irrevocable, royalty-free, sublicensable license to use that feedback for any purpose without obligation to you.
9. Confidentiality and security
Information shared during engagements is treated as confidential and is handled in accordance with the engagement agreement and our Privacy Policy. Vulnerabilities discovered during authorized assessments are disclosed only to the relevant client. We apply reasonable administrative, technical, and physical safeguards; however, no method of transmission or storage is perfectly secure.
10. Privacy
Your use of the website is also governed by our Privacy Policy and Cookie Policy, which are incorporated into these Terms by reference.
11. Third-party content and links
The website may contain links to third-party websites or content not owned or controlled by FortMind. We do not endorse and are not responsible for such third-party content, products, or services, and your use of them is at your own risk and subject to the terms of the relevant third party.
12. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE, ITS CONTENT, AND ALL TRAINING MATERIALS AND DELIVERABLES ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR FREEDOM FROM ERROR.
FortMind does not warrant that the website will be uninterrupted, timely, or error-free, that defects will be corrected, or that the website is free of viruses or other harmful components. Cybersecurity recommendations and assessments reduce, but cannot eliminate, risk; outcomes depend on factors outside our control, including your implementation, configuration, and operational practices.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORTMIND, ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH THE WEBSITE, OUR SERVICES, OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
FORTMIND'S AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THE WEBSITE, OUR SERVICES, OR THESE TERMS WILL NOT EXCEED THE AMOUNTS ACTUALLY PAID BY YOU TO FORTMIND FOR THE RELEVANT SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR ONE THOUSAND QATARI RIYAL (QAR 1,000), WHICHEVER IS GREATER.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, such as liability for fraud, gross negligence, or willful misconduct.
14. Indemnification
You agree to defend, indemnify, and hold harmless FortMind and its affiliates, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your breach of these Terms or any applicable law; (b) your misuse of the website or our services; or (c) any content, instructions, or data you provide that infringes a third party's rights.
15. Suspension and termination
We may suspend or terminate your access to the website or any service, with or without notice, if you breach these Terms, if required by law or by our service providers, or to protect the security or integrity of the platform.
Upon termination, your right to use the website ceases immediately. Sections that by their nature should survive termination (including intellectual property, confidentiality, disclaimers, limitation of liability, indemnification, and governing law) will continue to apply.
16. Force majeure
FortMind will not be liable for any failure or delay in performing its obligations to the extent caused by events beyond its reasonable control, including natural disasters, fire, flood, epidemic, war, civil unrest, acts of governmental authority, labor disputes, telecommunications or internet failures, third-party service failures, or cyber-attacks.
17. Export controls and sanctions
You represent and warrant that you are not located in, and will not use the website or our services in or for the benefit of, any country, region, or person subject to applicable trade sanctions or embargoes, and that you are not a person with whom FortMind is prohibited from dealing under applicable law. You will not export, re-export, or transfer our materials in violation of applicable export-control laws.
18. Anti-bribery and ethical conduct
Each party will comply with all applicable anti-bribery, anti-corruption, and anti-money-laundering laws. Neither party will offer, promise, or give any undue advantage to any person in connection with the website or our services.
19. Independent parties
Nothing in these Terms creates a partnership, joint venture, agency, employment, or fiduciary relationship between you and FortMind. Neither party has authority to bind the other.
20. Assignment
You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. FortMind may assign these Terms in whole or in part, including to an affiliate or in connection with a merger, acquisition, or sale of assets.
21. Notices and electronic communications
Notices to FortMind should be sent to info@fortmind.qa or by post to FortMind, Doha, State of Qatar. Notices to you may be delivered to the email address or postal address you provided. You consent to receive communications from us electronically, and you agree that all notices, agreements, disclosures, and other communications we provide electronically satisfy any legal requirement that they be in writing.
22. Time limit on claims
To the extent permitted by law, any claim or cause of action arising out of or related to the website, our services, or these Terms must be commenced within one (1) year after the cause of action accrues; otherwise, it is permanently barred.
23. Severability, waiver, and entire agreement
If any provision of these Terms is held to be unenforceable, the remaining provisions remain in full force and effect, and the unenforceable provision will be replaced with an enforceable one that most closely reflects the original intent.
Our failure to enforce any right or provision is not a waiver of that right or provision. These Terms (together with any signed engagement agreement and policies referenced) constitute the entire agreement between you and FortMind regarding the website and supersede all prior or contemporaneous communications, proposals, or representations.
Headings are for convenience only and do not affect interpretation.
24. Governing law and jurisdiction
These Terms are governed by the laws of the State of Qatar, without regard to its conflict-of-laws principles. The competent courts of Doha, State of Qatar, have exclusive jurisdiction over any dispute, claim, or controversy arising out of or relating to these Terms, except where applicable mandatory law requires otherwise. Where the engagement agreement provides for arbitration or another forum, that provision controls for the relevant dispute.
25. Language
These Terms are made available in English and Arabic. Both versions are intended to convey the same meaning. In case of any inconsistency between the two versions, and to the extent permitted by applicable law, the English version prevails for international engagements; the Arabic version prevails where required by Qatari law or for engagements where Arabic is the operative language.
26. Changes
We may update these Terms from time to time. Material changes will be reflected by a revised effective date at the top of this page, and where appropriate, by additional notice. Your continued use of the website or our services after changes take effect constitutes your acceptance of the updated Terms.
